I got my GC approved for me and son (I485 application) in Nov 2007. I got my gc, whereas for my son who is 7 year old though he got I485 approved yet he did not get his GC. They mentioned they might need his finger print and so far no response from them. This is despite several follow up with them.
Last year 7 months he was not in US and now can he go to India and he will be there rest of this year.
Will it affect his GC and when will he get his GC?

A friend of mine has PhD in aeronautics from a top tier university here in US. He will be soon starting teaching in a university and planning to file his GC under EB-1.
Are there any risks in getting I-140 approved under EB-1? or just having a PhD does not automatically qualify anyone under EB-1 category.?
Since he is born in India so reluctant to file under EB-2 due to endless wait.
Depends on whether the role for which he is applying requires a PhD or not. Once again, consult a good lawyer.

The Dallas suburb of Farmers Branch has been in the news for a couple of years now because of its efforts to run undocumented immigrants out of the city. The city leaders have attempted to do this by passing ordinances making it illegal to rent apartments or houses to such immigrants.
Unfortunately for the city, these ordinances keep getting shot down in court as unconstitutional, and the city has been forced to pay the legal fees of the plaintiffs who sue the city over the ordinances. After the latest adverse ruling, the Farmers Branch City Council voted this month to appeal the federal court judgment.
The rationale for the appeal is that this time the decision will be made by the 5th U.S. Circuit Court of Appeals, which is notoriously conservative. The city believes this court will be more likely to ignore or overturn other court opinions and decide that the ordinance is indeed constitutional.
The city's outside counsel has estimated the legal fees for an appeal could range from $100,000 to $150,000. Thus far, Farmers Branch has spent about $3.2 million trying to get illegal immigrants out of town, and has set aside another $620,000 for the remainder of 2010. By some estimates, the total legal costs could be more than $5 million by the end of this year. That's a lot of money for a city with a population of about 30,000.
For several years I lived in Carrollton, the suburb immediately north of Farmers Branch. I worked in Dallas, immediately south of Farmers Branch. So I passed through Farmers Branch at least twice each day, and actually was in the city far more than that. It's a nice town, with nice people. I hate to see all the negative publicity they are getting, although I do strongly disagree with their attempts to drive immigrants from Farmers Branch.
I know Farmers Branch has much more pressing needs for the money they are spending on these federal court appeals. Road maintenance, libraries, activities for senior citizens, and many other city projects are left wanting. That's a sad situation, and unfair to the residents of Farmers Branch.

I forgot that. they Do not need new I-94 every time. But I remember We were asked to put all Entry to Canada on I485 papers . I use to go Toranto Every week at that time.

Her employer is filing her H1 COS petition in premium processing, so I am hopeful it will be adjudicated within 15 days.
One more thing you can do is that file your wife's H4 to H1 in regular processing and any subsequent H1/H4 transfer you would do can be filed in premium and get them approved. I am sure if H4 to H1 COS is filed in regular processing, it will surely take a minimum of 4 to 5 months to be processed.

Issue is getting to Canada and staying there long enough with the high taxes they have average canadian tax burden is 40% (30% tax + 10% additional sales tax on everything you buy) !

If you indeed resign, there can be trouble..."luck factor" might pay a role.
But, I'm wondering why would you want to resign ? As long as your employer is a reasonably big one and has HR rules, you might be able to take FMLA...I think that can go for as long as 6 months. You will not get paid for a lot of it (depending on you leave balances). But, you will remain employed. And, you can work with your HR and legal folks to arrange a better alternative than resign.
Now, if your employer is a small place, then its all "it depends" thing...
Good luck...see to it that you don't extreme measures unless absolutely needed.

The Office of the Ombudsman is usually best addressed through 'non named' communication. By nature of the profession, Ombudsmen as neutral third parties and hence influence greater effects without direct name association. This is a technicality in the ADR/mediation profession.
For those who'd be more comfortable addressing Mr. , by all means no harm, no foul.
In any case, the Office of the Ombudsman in this can can be a POWERFUL resource because it can enable the Govt and USCIS Officials to take corrective action and place motivation on the Ombudsman instead of themselves. Thats how most bureaucracies work, find the person to pin the tail on and play the game.

People at the airports( I assume the same for checkpoints) care more about what's the date on the stamp and if you have a valid H1-B to support.
In my case, I had a company A's H1-B Visa stamping(Still valid at that time) and Company B's H1B papers.
Very rarely do they pull-over(it happened for me on a different occassion) and quiz you.
I believe when you say you are abandoning H1-B you are abandoning the petetion and not the Visa.

Your solution seems risky. USCIS may either issue an RFE later ,or straight away reject your application due to lack of evidence, so it is better negotiate with your old employer and get the document. If you get an RFE, you can submit the response even if the dates are not current. But, if your application gets rejected, you can reapply only when your PD is current, and that will make you to wait for years.

Like me all July filers would get off the H1-B hook come this Jan. I am assuming everybody would use newly gained freedom of EAD to switch employer or jobs. So far, not many employers like to get involved in H1 hassels ( espcialy in midwest), so recruiters had good business by hiring engineers at low rate and syphoning off majority share of the pay check.
But now, with 180 days (less than 75 days) limit over, all EAD holders are free to switch employers of jobs ( I know in same or similar capacity ... but that's not the point). The point is what would be the effect on current business contracting companies have? What would be the effect of EAD on their cost models and consistent revenues?
Not saying they would cease to exsist, as H1B's would still need them. But isn't new and bold demands from engineers like me going to affect their margins? ...What do you think?

Graduated from college last year, finally found a job that I really like. Currently on OPT. Just curious to know how long will it take for employer to apply for labor and I-140.
I know most of you are thinking - "are you mad, esp with current gc situation? " the thing is I like it here. My relatives and friends are here. I am hoping that with so many people stuck in the gc process, somebody has to fix it soon - and I (& other newcomers) will benefit from better immigration policy.
