Both my wife and I also received a RFE on June 29th but don't know the content of the RFE because haven't received the CIS letter yet. I did submit the BC, however, so I hope that the RFE is not for BC. I don't know what else it could be.. I have been scratching my head since I got the email yesterday. Also called CIS but they wouldn't tell me what the RFE is about.

My NIW/I-140 application has been pending for a year. During this time, I have more qualifications added to my resume. Is there a mechanism to send my updated resume or should I just let it be?

They asked me to send additional evidence in support of my NIW petition. I'd say just wait for them to ask you anything that they require to justify NIW.

My wife's name was changed when we got married in the passport to add my name as her last name.
This is not reflected on her birth certificate.
I am planning on taking 2 affadavits. But I don't have a format for this special case.. Is there any one who has gone thru this ? Also pls provide me with the format...

Yes one must be a Greencard holder to attain unemployment benifits.
Not permitted with EAD.
This is not true. People in AOS can apply for unemployment benefits. Unemployment benefits are paid by employers and all you need is an A number to get it.

Just in case someone might find this useful --
I had appeared for my visa stamping (9th year extension). It went fine. I'd used these forums to collect all the needed info so thanks to everyone ! I was little nervous but had no choice because my company had sent me for a business trip. At the consulate, security was very good. They even had places to leave your belongings. I saw people come in with cellphones, keys etc and they were check them in the security. Once through the security initial check ups took place where they put the needed documents in a file.
- At this point the person checking my docs marked red on the section where I had marked that my sibling was permanent resident.
- went to the first window where the officer checked for PIMS and wrote "no PIMS" (again in red) on my ds156 form. He asked couple of questions about where I work and then the finger print formality.
- waited for a while and finally I was called for the interview. The VO asked about my job, degree and what my role was at the company. I work for very large fortune 500 company and our division in Germany is well known.
- She left couple of times to check my PIMS records and finally told me that your visa will be approved and sent in 3-5 business days. That's how they do it consulates in Germany. You are not allowed to come and collect the passports.
- But, then she again checked my degree (EE) and mentioned that they may have to do some additional processing and will get back to me.
- But, she kept the passport and other docs so I was confident that it is only for PIMS verification. After 3 days I got back my passport with stamping. I provided all the answers with confidence and very legibly.
We just have to do what we have to do and leave the rest to whatever happens. I'd prepared everything before my trip in case I've go to India and get stamped (I'm getting tired of these long and stressful procedures, I was the only one with some many docs whereas others walked in with few sheets, go figure !).
Anyway, everything went well! Please let me know if any of you have questions and good luck to all. Hope none of us have to get stuck in the PIMS mess. Also, the PIMS process seems to have been cleaned up. Because of large amount of complaints looks like they are clearing it faster and providing the decision back to consulates much faster.

Aha I see ... yes she can stay in the US beyond the I-94 date as long as the extension application is pending. From the postings i can recollect that in case of a denial the unlawful presence starts from the decision date.
also if you get denial stamp no longer be valid. This is what I also read online.

Oh for windows development you would want to look into WPF. The basic idea is to change the border style for the window to none (don't know the exact c++ way, but a google search should show). Then you will want to draw your own windows and drag areas.
Also its usually best practice to keep the windows the same from app to app.

Sorry for the confusion. i am not deported. One of my company's new employee was deported at POE. Yes. POE did called my employer and asked where he is going to work. My employer said he is going to work on our company site. Then the officer said your empoyee told us that he is going to work at client site. Then the officer said he will call back.
Officer called back after 30min and told my employer that your emplyee submitted some fraud document. And then my employer said i am not liable what he did and explined the officer that he was doing bussinees more than 8 years and have all the proper documents.
Then the officer said he understand the situation and said he is just doing duty. Officer said he is going to send a report to DOL.

My PERM (EB2) was filed mid January 2008, less than 365 days before my second term H1B will expire in October 1, 2008. The case was audited in March and we responded in April 2008 to the Atlanta Processing Center. Since then, no news.
From what I understand from my lawyer, there will be a time gap when I will be without H1B status between October 1, 2008 and mid January 2009, when I will be eligible for an automatic H1B extension due to the PERM pending for more than 365 days. This time gap comes to a total of about 110 days.
My lawyer suggests spending these 110 days out of the country before October 1st, so they can be filed as a �time recap� and added to my H1B October expiration date. As a result, this would get me to mid January 2009 for the H1B visa extension, so I can stay continuously in the US.
As of now, I already accumulated about 60 days � all from vacation during the 6 years on H1B. If I applied this for time recap, it would get me through December 1, 2008. If I can avoid it, I would rather not spend the remaining 50 days abroad before my H1B visa expiration.
Questions:
Recap eligibility
- Does paid vacation count as time out of the country for recap filing and added to the H1B expiration date?
- Do travel dates also count or only full days abroad?
Recap filing
- If the recap filing of 60 vacation days get me to December, can I still go in and out of the country between October and December -- even though my H1B officially ended in October?
- Can I do a recap filing several times for time periods that I might stay out of the country between October and December, so eventually it would get me to mid January, the date when the H1B extension can be filed?
Filing after PERM approval
- What are the next filing steps if I get my LC approved before / after October or December?
My lawyer, hired by my employer, keeps me in the dark. Is my information correct? Are there any work-arounds?

Then the big C may have to deal with the Deeez in majority in congress. A democratic congress will pass a most liberal immigration bill they can imagine. The republicans will be far better served compromising now than waiting if democrats take congress. Right now the Dems, the Prez and the Senate are on the same page.
