You cannot travel and enter US with expired AP. Please renew your AP. Stamp on AP cannot make any difference as per my knowledge. You will have your I-94 also with same time stamp.

My AP document expired in NOv 2008. I traveled to India and got back in Aug 2008. The officer stamped the document and wrote paroled until Aug 2009.
Can I travel on this document?

AILA Leadership Has Just Posted the Following:
The battle for comprehensive immigration reform is going to be tough as Senate Republicans play politics with the critical immigration issue. The Senate passed its $44.3 billion fiscal 2010 Homeland Security appropriations measure 84-6 last week after three days of debate that differentiated the bill from its House companion on a handful of border security and immigration policies. Unfortunately Senate Republicans used the opportunity to add significant new provisions to the less controversial �extender provisions� including an extension to the Special Immigrant Nonminister Religious Worker Program and the Conrad Waiver Program for Physicians Serving in Underserved Areas. The Senate also included a provision promoted by AILA member Brent Renison to allow the foreign-born widows, children and parents of citizens who have died to retain their legal status to seek citizenship for two years after the death. Even the Homeland Security Department spokesman Matthew Chandler said the Senate endorsement of Vitter's measure prevents real progress on immigration enforcement and is "a reflection of the old administration's strategy: all show, no substance."
In contrast, the Obama administration is trying to implement effective enforcement, he said. The January 2011 Visa Bulletin shows significant retrogression of family-based categories with priority dates falling back as much as one to three years. The 1st preference category (unmarried children of U.S. citizens) shows an increased wait from 5 years to 6 years. The 2A preference category (spouses and children of legal permanent residents) suffers the largest setback with an increase from 4 months to 3 years, while the 2B preference category (unmarried adult children of legal permanent residents) experiences an increase from 5 1/2 to 8 years. The 3rd preference category (married children of U.S. citizens) shows an increase from 8 1/2 years to 10 years. The 4th preference category (brothers and sisters of U.S. citizens) was the only family-based category unaffected by the retrogression, remaining at a 9 year wait.
Employment-based categories did not experience any retrogression and are as follows: EB-1 remains current for all countries; EB-2 remains current, except for India (May 2006) and China (June 2006); EB-3 is at Mar. 2005 for all countries, except for India (Feb. 2002), China (Dec. 2003), and Mexico (April 2003); EB-3 other workers is at April 2003 for all countries, except India (Feb. 2002); EB-4, religious workers, EB-5, and targeted employment areas and regional centers are all current.

As soon I got the receipt number, I started working for Company B. Now I have paystubs for almost 8 months. With those pay stubs, can i transfer to company C? If Company C files for a H1 transfer, with which H1B receipt will he file for transfer-H1B approval copy of employer A or H1B receipt of employer B? My attorney feels that my H1 transfer petition with Company B has got stuck in a security/background check, since USCIS has not responded to 2 SR's placed by my attorney and added that PP will not help if my petition got stuck in security check.

Its alright most of the time USCIS looks for last year or last 2 years tax return. I think W-2 is good enough to prove that you are eligible for Tax return.

Hi all,
My wife has MSc in Comp and has work experience of 2 yrs as a programmer in India. She came last year on F2 and applied for H1 this year but She didn't get selected in the lottery. Someone told her that she can apply for jobs in universities and they do H1 (no cap).
Can someone tell us that this is true? and also suggest us where else can she try looking for jobs? Are all the Not-for-Profit organizations same in terms of doing H1 (no cap)?
I appreciate any suggestions and thanks in advance.

I have lost one of the old H4 I797 originals of my spouse. What is the process for getting a duplicate of it. I saw somewhere that I824 needs to be applied. But not sure of below doubts.
1. Who should apply I824? employer or individuals ( in this case myself)?
2. If employer need to apply, should it be current employer?
3. how long does it generally take?
4. Is it ok if I dont know the approval number as I dont have a copy of the I797.
5. What other documents are required?

The only difference is if you work for the univ on a cap exempt H1b and than transfer to industry on a cap H1b then you would have to go through the lottery or masters quoto whatever applies...however there is a loophole in this and I have read somewhere that when you apply for a transfer for a cap exempt to cap subject USCIS have goofed up and let it go through
